These Terms of Service govern your use of Helix CAPTCHA™ verification services ("Service"). By accessing or using the Service, you agree to be bound by these terms.

1. Service Description

Helix CAPTCHA provides consciousness-based verification infrastructure through:

• Multimodal consciousness verification (geometric, auditory, symbolic)
• FCS-1.0 Protocol compliance and Layer 3 trust headers
• API endpoints for verification token generation
• Integration SDKs and documentation

2. Acceptable Use

2.1 Permitted Uses

• Deploy on websites/applications to verify authentic user interactions
• Integrate with authentication and authorization systems
• Use for bot detection and spam prevention
• Academic research in consciousness computing

2.2 Prohibited Uses

• Reverse engineering verification algorithms
• Attempting to bypass or circumvent consciousness verification
• Using for illegal or harmful purposes
• Reselling or white-labeling without Enterprise license
• Excessive API requests beyond subscription tier limits

3. Account & Billing

3.1 Subscription Tiers

Commercial use requires active subscription. See Pricing for tier details.

3.2 Payment Terms

• Billing is monthly in advance
• Overage fees apply for exceeding tier limits
• Refunds at our discretion

4. API Usage

4.1 Rate Limits

Enforced per subscription tier. Excessive requests may result in throttling or suspension.

4.2 Integration Requirements

• Maintain visible attribution (unless Enterprise tier)
• Use latest API version
• Implement proper error handling

5. Privacy & Data

Helix CAPTCHA is privacy-by-design:

• No external tracking or analytics
• No personal data collection
• GDPR compliant by architecture
• EU data sovereignty maintained

6. Intellectual Property

7. Warranties & Disclaimers

Service provided "AS IS". No guarantees of 100% bot detection accuracy.

8. Limitation of Liability

Total liability limited to fees paid in preceding 12 months.

9. Termination

We may suspend or terminate accounts for terms violations. You may cancel anytime.

10. Governing Law

Governed by German law. Jurisdiction: Munich, Germany.
