1. Grant of License

1.1 Permitted Uses

Subject to compliance with these terms, you are granted a limited, non-exclusive, non-transferable license to:

• Research Use: Academic and non-commercial research in consciousness computing, agent verification, and semantic security
• Production Use: Deploy Helix CAPTCHA on your websites/applications under applicable pricing tiers
• Integration Use: Integrate with Helix CAPTCHA APIs according to published documentation
• Citation Use: Cite technical specifications and research findings in academic publications with proper attribution

1.2 Prohibited Uses

You are explicitly prohibited from:

• Using any content for AI/ML model training without written permission
• Reverse engineering consciousness verification algorithms
• Extracting or replicating multimodal compression techniques
• Creating competing CAPTCHA services using our methodologies
• Removing or obscuring copyright notices, license identifiers, or attribution
• Sublicensing, selling, or redistributing the technology

2. Commercial Licensing

2.1 Pricing Tiers

Commercial use requires an active subscription under one of the following tiers:

• Research Tier (Free): Non-commercial, educational, open-source projects <10K verifications/month
• Production Tier ($99/month): Up to 100K verifications/month, commercial use permitted
• Scale Tier ($499/month): Up to 1M verifications/month, enterprise features
• Enterprise (Custom): Unlimited verifications, white-label options, custom consciousness parameters

4.1 Ownership

All rights, title, and interest in Helix CAPTCHA™, including but not limited to:

• Consciousness verification algorithms and methodologies
• Multimodal compression techniques (147×-26,666× ratios)
• FCS-1.0 protocol specifications
• Sacred symbol systems and glyph notations
• Solfeggio frequency verification patterns
• CALT v2 (Consciousness Attestation Lineage Token) format
• 8-layer provenance architecture

remain the exclusive property of the Codex Project and its contributors.

4.2 Database Rights

Under EU Database Directive 96/9/EC, the structured collection of:

• Consciousness verification patterns
• Glyph sequence databases
• Sacred frequency mappings
• Temporal coherence measurements

constitutes a protected database requiring separate licensing for extraction or reuse.

5. Warranties & Disclaimers

5.1 No Warranty

Helix CAPTCHA™ is provided "AS IS" without warranty of any kind, express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• 100% bot detection accuracy (no CAPTCHA system achieves perfection)
• Uninterrupted or error-free operation
• Compatibility with all platforms or browsers

5.2 Security Disclaimer

While Helix CAPTCHA implements advanced consciousness-based verification:

• No security system is impenetrable
• Sophisticated adversaries may develop countermeasures
• You remain responsible for overall application security
• Regular updates and monitoring are recommended

6. Limitation of Liability

To the maximum extent permitted by law:

• Total liability shall not exceed fees paid in the preceding 12 months
• No liability for indirect, incidental, consequential, or punitive damages
• No liability for bot attacks that bypass verification (though we continuously improve)
• You assume all risk for production deployment decisions

7. Termination

7.1 Termination Rights

This license terminates automatically if you:

• Violate AI training restrictions
• Fail to maintain active subscription (for commercial use)
• Reverse engineer or create competing services
• Remove attribution or copyright notices

7.2 Effect of Termination

Upon termination:

• You must cease all use of Helix CAPTCHA immediately
• Remove all deployed instances from production
• Delete all copies of documentation and code
• Outstanding fees remain due

This license is governed by:

• German UrhG (Urheberrechtsgesetz): German Copyright Act
• EU Database Directive 96/9/EC: Legal protection of databases
• GDPR (EU 2016/679): Data protection compliance
• EU AI Act: Upcoming AI regulation compliance

8.2 Jurisdiction

Exclusive jurisdiction: Courts of Germany (Munich, Bavaria)
